Product Disclaimer

This Product Disclaimer applies to jewellery displayed, advertised and sold by Bombay Jewellery and Cosmetics, under the brand Bombay Jewellery, through https://bombayjewelleryhp.in.

Customers should carefully review the relevant product description, photographs, measurements, materials, size information, care instructions, guarantee status and exchange eligibility before placing an order.

1. Nature of Our Products

Unless an individual product listing expressly states otherwise, our products are:

  • Artificial jewellery;
  • Imitation jewellery;
  • Fashion jewellery;
  • Gold-plated jewellery; or
  • Decorative jewellery.

They are not:

  • Solid gold jewellery;
  • Investment gold;
  • Precious-metal bullion;
  • Natural diamond jewellery;
  • Certified precious gemstones;
  • Financial products; or
  • Investment assets.

Customers should rely on the material and composition stated on the relevant product page and invoice.

2. Descriptive Jewellery Terms

Terms such as:

  • Gold-plated;
  • Gold finish;
  • Golden;
  • Matte gold;
  • Antique gold;
  • Silver finish;
  • Diamond look;
  • AD stone;
  • American diamond;
  • Kundan look;
  • Polki look;
  • Pearl;
  • Ruby colour;
  • Emerald colour;
  • Premium;
  • Royal;
  • Traditional; or
  • High-class

may describe a product’s plating, finish, colour, appearance, style or decorative components.

These terms do not represent that the product is made from solid gold, natural diamonds, natural pearls, natural rubies, natural emeralds or another precious material unless the product listing expressly and accurately states so.

3. Product Photographs

We make reasonable efforts to display products accurately.

However, the product’s actual colour, shine, texture or appearance may vary slightly because of:

  • Studio lighting;
  • Natural lighting;
  • Camera settings;
  • Image compression;
  • Background colour;
  • Reflections from plated surfaces;
  • Screen brightness;
  • Mobile or computer display settings; and
  • Individual visual perception.

A minor visual variation that does not materially change the product will not ordinarily constitute a defect.

4. AI-Assisted and Digitally Enhanced Images

Some lifestyle, model or promotional images may be digitally enhanced or created with artificial-intelligence tools.

These images may be used to demonstrate:

  • Styling;
  • Occasion;
  • Outfit coordination;
  • Approximate scale;
  • Presentation; or
  • The overall look of a product when worn.

AI-assisted or lifestyle images should not be treated as an exact representation of the model, setting, surrounding accessories or product scale.

We will endeavour not to materially alter or misrepresent the jewellery being sold.

Customers should rely primarily on:

  • Original product-only photographs;
  • Written product specifications;
  • Measurements;
  • Materials;
  • Available videos; and
  • “What You Will Receive” information.

If an illustrative image conflicts with an original product photograph or written specification, the original product photograph and written specification should be used to understand the actual item.

5. Product Videos

Product videos may be affected by:

  • Lighting;
  • Camera movement;
  • Lens settings;
  • Video compression;
  • Screen settings; and
  • Reflections from stones or plated surfaces.

Videos are intended to provide additional visual guidance but do not replace written measurements and material specifications.

6. Measurements and Weight

Measurements, length, width, diameter and weight may be approximate unless expressly stated as exact.

Minor differences may arise from:

  • Manual measurement;
  • Manufacturing tolerances;
  • Handmade finishing;
  • Stone or bead placement;
  • Decorative components; or
  • Product-batch variations.

The scale of a product may look different on different people because neck, ear, wrist, hand and body proportions vary.

Customers should review written dimensions and size information rather than relying only on model photographs.

7. Handmade and Batch Variations

Certain products may include handmade, hand-finished or manually assembled components.

Minor differences may naturally occur in:

  • Stone placement;
  • Bead shape;
  • Pearl shape;
  • Surface texture;
  • Polish;
  • Colour tone;
  • Pattern alignment;
  • Decorative detailing; and
  • Finishing.

Such minor characteristics may form part of the product’s individual nature and will not necessarily constitute a manufacturing defect.

8. Stones, Pearls and Decorative Elements

Unless expressly stated otherwise, stones, pearls, beads and coloured elements may be artificial, simulated or decorative.

Natural minor differences in shade, surface, size, transparency and reflection may occur.

Decorative components may loosen or become detached because of:

  • Impact;
  • Pulling;
  • Bending;
  • Moisture;
  • Sweat;
  • Chemicals;
  • Improper storage;
  • Rough handling; or
  • Ordinary wear.

A manufacturing or stone-setting defect should be reported within the applicable return or guarantee period.

9. Gold Plating and Colour Longevity

Gold plating and other artificial finishes naturally experience wear over time.

The life of the finish depends on:

  • Frequency of use;
  • Skin chemistry;
  • Sweat;
  • Moisture;
  • Humidity;
  • Perfume;
  • Deodorant;
  • Cosmetics;
  • Lotion;
  • Sanitizer;
  • Soap and chemicals;
  • Friction;
  • Climate;
  • Storage; and
  • Product-care practices.

No plated jewellery can be represented as permanently resistant to all fading, tarnishing, scratching or colour changes.

A seven-day guarantee applies only where the product page or invoice expressly states that the product is “Guaranteed.”

10. Product Care

To help preserve the jewellery:

  • Keep it away from water and moisture;
  • Remove it before bathing or swimming;
  • Remove it before exercising or sleeping;
  • Avoid direct contact with perfume and deodorant;
  • Avoid cosmetics, lotion, sanitizer and chemicals;
  • Wear jewellery after applying makeup and perfume;
  • Do not pull, twist, bend or drop the product;
  • Wipe it gently with a clean, soft and dry cloth;
  • Store each product separately;
  • Use a dry pouch or jewellery box;
  • Avoid prolonged humidity or direct sunlight; and
  • Keep it away from children and pets.

Failure to follow reasonable care instructions may result in fading, tarnishing, scratches, breakage or loose components not covered by the guarantee.

11. Skin Sensitivity and Allergies

Individual sensitivity to metals, alloys, adhesives, plating and decorative components varies.

Artificial or gold-plated jewellery may cause irritation or an allergic reaction in some individuals.

Customers with sensitive skin, known metal allergies or dermatological conditions should review available material information and consult an appropriate healthcare professional where necessary.

Stop using the product if redness, itching, swelling, pain or irritation occurs.

We do not represent that every product is hypoallergenic, nickel-free or suitable for sensitive skin unless the individual listing expressly states so.

12. Health and Safety

Jewellery may contain small parts that can present a choking or swallowing risk.

Customers should:

  • Keep jewellery away from babies and young children;
  • Avoid placing jewellery or components in the mouth;
  • Supervise children wearing jewellery;
  • Stop using damaged jewellery with sharp edges; and
  • Use the product only for its intended decorative purpose.

Our jewellery is not a toy or medical product.

13. Earrings and Hygiene

For health and hygiene reasons, earrings are generally non-returnable after delivery.

An exception may apply where the earrings are:

  • Damaged on delivery;
  • Defective;
  • Incorrectly supplied;
  • Materially different from their listing; or
  • Subject to another mandatory consumer remedy.

The claim must be raised within the applicable reporting period.

14. Size and Fit

Customers are responsible for checking product measurements and selecting the correct size before ordering.

Fit may vary according to:

  • Individual proportions;
  • Product design;
  • Styling preference;
  • Wearing method; and
  • Measurement technique.

An eligible size-related return may be considered where the product remains unused and unworn, the tag remains attached, the packaging is intact and the required replacement size is available.

If the customer selected the wrong size, the customer must pay the applicable return and re-delivery costs.

15. Customized and Personalized Products

Customized or personalized products are made or altered according to customer instructions.

Minor handmade or production variations that remain consistent with the approved design will not ordinarily constitute a defect.

The customer is responsible for checking:

  • Name or initials;
  • Spelling;
  • Size;
  • Measurements;
  • Length;
  • Colour;
  • Design;
  • Quantity; and
  • Other customization instructions

before approval.

Customized and personalized products are generally non-cancellable after work begins and non-returnable after delivery.

An appropriate remedy may still apply where the product is damaged, defective, incorrectly supplied or materially different from the approved specifications.

16. Sale and Discounted Products

Sale, discounted and clearance products are generally non-returnable.

An exception may apply where such a product is:

  • Damaged;
  • Defective;
  • Incorrectly supplied;
  • Materially different from its listing; or
  • Subject to a mandatory consumer remedy.

A lower sale price does not by itself indicate a product defect.

17. Change of Mind

We do not ordinarily accept a return merely because the customer:

  • Changes their mind;
  • Does not like the product;
  • No longer needs it;
  • Finds that it does not match an outfit;
  • Expected a different size without checking the measurements; or
  • Prefers another design after delivery.

This restriction does not apply where the product is damaged, defective, incorrectly supplied, materially different from its listing or subject to a mandatory legal remedy.

18. Seven-Day Product Guarantee

The Seven-Day Product Guarantee applies only to products whose product page or legal invoice expressly states “Guaranteed.”

The guarantee begins on the date of delivery.

Subject to inspection, it may cover:

  • Colour or plating defects arising during the guarantee period;
  • Manufacturing defects;
  • Stone-setting defects; and
  • Breakage caused directly by a manufacturing defect.

The guarantee does not ordinarily cover:

  • Normal wear and tear;
  • Expected gradual fading;
  • Accidental or customer-caused breakage;
  • Scratches;
  • Bending or pulling;
  • Impact damage;
  • Exposure to water or sweat;
  • Contact with perfume, cosmetics or chemicals;
  • Improper storage;
  • Missing components resulting from use;
  • Unauthorized repair or alteration; or
  • Failure to follow care instructions.

The available remedy will depend on inspection, product availability, the nature of the defect and applicable law.

19. Lifetime 50% Exchange Programme

The Lifetime 50% Exchange Programme applies only where the product page or invoice expressly states that the product is eligible.

It is not:

  • A warranty;
  • A cash buyback;
  • A refund;
  • An investment scheme;
  • A precious-metal valuation; or
  • A guaranteed resale programme.

Subject to the detailed Lifetime 50% Exchange Policy:

  • The original invoice or a readable photograph/digital copy is compulsory;
  • The old product must be physically returned;
  • The product must pass verification and inspection;
  • The benefit may be used once per eligible product;
  • A new product must be purchased from the same category;
  • No cash refund is provided;
  • The customer pays all transportation costs; and
  • The exchange value is applied only against an eligible new purchase.

The exchange value equals 50% of the original taxable product value after excluding GST.

It is not based on gold weight, market price, melting value or resale value.

20. Packaging

Product packaging shown in photographs may be illustrative.

The supplied box, pouch, display card or other packaging may vary depending on:

  • Product type;
  • Availability;
  • Shipping requirements;
  • Supplier changes; or
  • Promotional campaigns.

A packaging variation does not constitute a product defect unless a specific packaging item was expressly included as part of the purchase.

21. Included and Excluded Items

Background decorations, model clothing, props, display stands and other styling accessories shown in photographs are not included unless expressly stated.

Customers should review the product description and “What You Will Receive” section to understand the exact contents of the order.

22. Product Availability and Design Updates

Product availability is subject to stock.

We may discontinue a product or update its packaging, presentation or non-material specifications.

We will not intentionally substitute a materially different product without the customer’s consent.

If an ordered product becomes unavailable, the customer may be offered an alternative or an eligible refund. The customer is not required to accept an alternative product.

23. Prices and Promotional Claims

Prices, discounts and promotions may change.

The amount displayed at checkout when the order is placed will apply, subject to correction of an obvious technical or pricing error.

Terms such as “premium,” “royal,” “luxury look,” “traditional,” “festive” or “high-class” describe style and brand presentation. They do not independently represent precious-metal content, investment value or certification.

Promotional benefits remain subject to their clearly disclosed eligibility conditions and validity periods.

24. Customer Inspection After Delivery

Customers should inspect the parcel and products promptly after delivery.

A damaged, missing or incorrect-product claim should be reported within 48 hours after delivery.

Customers should preserve:

  • The product;
  • Original tag;
  • Invoice;
  • Outer packaging;
  • Shipping label;
  • Product packaging;
  • Accessories; and
  • All included components.

The product should not be used, worn, cleaned, repaired or altered after a problem is discovered.

25. Unboxing Video

For damaged, missing or incorrect-product claims, customers should record a clear, continuous parcel-opening video beginning before the sealed outer package is opened.

The video should show:

  • Shipping label;
  • Sealed package;
  • Complete opening process;
  • All contents; and
  • Reported issue.

The unboxing video is preferred primary evidence. However, every complaint will be assessed on its facts and all available evidence.

This evidence requirement does not remove a mandatory consumer remedy.

26. No Investment or Resale Representation

Artificial and gold-plated jewellery is sold for personal adornment and fashion use.

We do not promise:

  • Appreciation in value;
  • Precious-metal value;
  • Resale value;
  • Cash buyback;
  • Investment return; or
  • Acceptance by another jeweller.

Any applicable Lifetime 50% Exchange benefit is a separate commercial programme governed by its specific conditions.

27. Limitation of This Disclaimer

Nothing in this Product Disclaimer excludes or restricts a right or remedy that cannot legally be excluded under Indian law.

This Disclaimer does not remove our responsibility for a product that is:

  • Defective;
  • Falsely described;
  • Incorrectly supplied;
  • Materially different from its listing; or
  • Supplied in violation of applicable law.

Where this Disclaimer conflicts with a mandatory legal requirement, the legal requirement will prevail.

28. Changes to This Disclaimer

We may update this Product Disclaimer to reflect product, operational, legal or regulatory changes.

The revised version will be published on the website with an updated revision date. Changes will apply prospectively and will not unfairly remove rights already accrued in relation to an accepted order.
